Micro in retail/service biz, pandemic-hit firms may apply for exemption from wage hike

Under the Omnibus Rules on Minimum Wage Determination, the following establishments may apply for exemption from compliance with the issued Wage Orders:

  1. Retail/service establishments regularly employing not more than ten (10) workers; and
  2. Establishments affected by natural calamities and/or human-induced disasters, including the pandemic.

From the 2020 List of Establishments of the Philippine Statistics Authority, micro establishments comprise 88.77% of the total business enterprises in the Philippines. Hence, the exemption will temper the impact of the wage increase on the business operation of retail/service establishments employing not more than 10 workers. The exemption will also provide a breathing space for micro, small and medium enterprises (MSMEs) that suffered from the pandemic to resume their business operations and to fully recover.

Businesses in retail/service sector employing not more than 10 workers shall submit their application for exemption, including their affidavit of undertaking and certified true copy of their business permit, to the Regional Tripartite Wages and Productivity Boards having jurisdiction over their workplace not later than seventy-five (75) days from the date of publication of the Wage Order.

MSMEs affected by the pandemic shall submit their affidavit showing the nature and impact of the pandemic on their business operation as well as Audited Financial Statements (AFS) for the last two (2) years stamped received by the Bureau of Internal Revenue. In extreme cases, the interim AFS may be required in lieu of the last two years’ AFS.

The granted exemption is valid for one (1) year. Exempted establishments shall pay their workers with the prescribed and applicable wage rates in the previous Wage Order. ###OD

Maaaring mag-apply ng exemption mula sa pagtaas ng sahod

Sa ilalim ng Omnibus Rules on Minimum Wage Determination, maaaring mag-apply ng exemption mula sa inilabas na Wage Order ang mga sumusunod na establisimyento:

  1. Mga retail/service establishment na regular na nageempleyo nang hindi hihigit sa sampung (10) manggagawa; at
  2. Mga establisimyentong naapektuhan ng kalamidad; kabilang ang pandemya.

Mula sa 2020 List of Establishments ng Philippine Statistics Authority, ang mga micro establishment ay binubuo ng 88.77% ng kabuuang negosyo sa Pilipinas. Kaya naman, ang exemption mula sa pagtaas ng sahod ay makatutulong sa mga negosyo na nasa retail/service establishment na may hindi hihigit sa 10 manggagawa. Magbibigay din ito ng ‘breathing space’ para sa mga micro, small and medium enterprises (MSMEs) na naapektuhan ng pandemya na maipagpatuloy ang operasyon ng kanilang negosyo upang ganap na makabangon.

Dapat magsumite ng kanilang aplikasyon para sa exemption ang mga negosyo sa retail/service sector na may hindi hihigit sa 10 manggagawa, kasama ang kanilang affidavit of undertaking at certified true copy ng kanilang business permit, sa Regional Tripartite Wages and Productivity Boards na may hurisdiksyon sa lugar ng kanilang pagawaan or trabaho nang hindi lalampas sa pitumpu’t limang (75) araw mula sa petsa ng pagkakalathala ng Wage Order.

Ang mga MSME na naapektuhan ng pandemya ay dapat magsumite ng kanilang affidavit na nagpapakita kung paano naapektuhan ng pandemya ang operasyon ng kanilang negosyo gayundin ang Audited Financial Statements (AFS) para sa huling dalawang (2) taon na may tatak na natanggap ito ng Bureau of Internal Revenue (BIR). Sa malulubhang kondisyon, ang pansamantalang AFS ay maaaring isumite bilang kapalit ng huling dalawang taon na AFS.

May bisa ng isang (1) taon ang exemption na ibibigay. Dapat bayaran ng mga establisimyentong may exemption ang kanilang mga manggagawa sa itinakda at naaangkop na rate ng sahod batay sa nakaraang Wage Order. ###OD/ gmea
